The following is a list of upcoming public hearings on our proposed rules.

What information can I find?

  • A list of proposed rules scheduled for that hearing.
  • The contact person for more information about the proposed rules.
  • Washington State Register (WSR) publication numbers.
  • A link to the Proposed Rule Making Order (CR-102) and the proposed rule text.

Select the WSR number (e.g., WSR 13-17-104) to view or print a copy of the CR-102 and proposed rule text.

To comment on any CR-102, email the HCA rules coordinator or testify at the public hearing in person or virtually. If you have questions about the rule, send a message to the contact person.

How to register for hearing

  1. Expand the container for the rule you are interested in.
  2. Find the Proposed Rule Making Order (CR-102) hearing you want to attend.
  3. Click the link for the WSR to open the CR-102.
  4. On the CR-102, click the registration link on the right (under Comment). (If the registration page returns an error message, please try a different browser.)
  5. Enter your registration information, including a valid email address. This registration information is part of the public hearing record and is subject to public disclosure.

Once you have registered, you will be emailed a link to the webinar. Each link is unique to the registrant. Registrants may not share links.

Additional information about virtual hearings

  • The webinar audio is recorded.
  • Attendees are automatically on mute.
  • Attendees cannot be seen by other attendees, except for Health Care Authority (HCA) staff who may be in attendance in the HCA conference room where the virtual hearing is being conducted.
  • Attendees who wish to testify must wait for the specific rule they are interested in to be read, then select the “Raise your hand” option.
  • The hearing officer will call on each attendee who has a hand raised, one at a time, and unmute their mic. At that time, the attendee may begin their testimony.
  • The hearing officer may limit public testimony to a specific timeframe because of time constraints. Written comments may also be submitted to supplement testimony.
  • The hearing officer may mute and dismiss (remove) an attendee from a public hearing if the attendee is disruptive or offensive. If removed from the public hearing, the attendee will not be able reenter the hearing.

Written comments can also be submitted through the remainder of the day of the public hearing. Email written comments to arc@hca.wa.gov.

• SEBB 2024-01 Amending Resolution SEBB 2021-02: School employees may waive enrollment in medical
• SEBB 2024-02 Amending Resolution SEBB 2021-03: SEBB benefit enrollment requirements when PEBB benefits
are waived
• SEBB 2024-03 Amending Resolution SEBB 2021-05: Resolving dual enrollment involving dual subscriber eligibility
• SEBB 2024-04 Amending Resolution 2021-07: Resolving dual enrollment involving a member with multiple medical

Description
The purpose of this
proposal is to amend WAC 182-30-130 to support the School Employees Benefits Board (SEBB) Program:
1. Implement School Employees Benefits (SEB) Board Policy Resolution:
• Implemented Resolution SEBB 2023-04 When a subscriber has a change in residence or employment location that
affects medical plan availability
2. Make other technical amendments:
• Updated flexible spending arrangement references;
• Amended special open enrollment events by including when a school employee has a change in residence, a change
in employment location, and when the SEBB Program determines that there has been a substantial decrease in the
providers available under the SEBB medical plan.

1. Implement School Employees Benefits (SEB) Board Policy Resolution:
• Implemented Resolution SEBB 2024-06 continuation coverage when a term of board member of a school district
ends
2. Implement legislation:
• Updated flexible spending arrangement (FSA) references to implement SB 5700
• Added WAC references that include school board members to implement SSB 5275
3. Make other technical amendments:
Clarified an enrollee’s COBRA coverage will terminate when their Medicare coverage begins

Description
The agency is adopting
this new rule to establish eligibility criteria for the Civil Transition Program, which is a state-funded, fee-for-service program
that requires the Department of Social and Health Services (DSHS) to provide wraparound services and supports in
community-based settings, which may include residential supports, to persons who have been found not competent to stand
trial due to an intellectual or developmental disability, dementia, or traumatic brain injury. This Apple Health program is for
persons who are not eligible for any other Apple Health program and will provide state-funded categorically needy coverage.
This program implements a portion of RCW 10.77.202, which became effective December 1, 2023. The agency established
WAC 182-538B-180 through an emergency rule filed under WSR 23-24-052 and refiled under WSR 24-08-051. The purpose
of this rulemaking is to make that rule permanent and to renumber it as WAC 182-508-0200. DSHS is engaged in rulemaking
on this subject. DSHS filed a preproposal statement of inquiry under WSR 23-24-046 and established emergency rules under
WSR 24-05-046.
